RIVERSIDE MEETING

Come meet with the Riverside Core Team, led by Terry Toussaint, which is addressing head-on the proposed changes to dog laws. The City of Riverside is considering the adoption of a Long Beach-style ordinance. Long Beach's animal ordinances include mandatory spay/neuter, breeder licensing so complicated that not one breeder license has ever been issued, and retail pet sales restrictions. What originates in the City often spreads to the entire County, and eventually state-wide, so this discussion should be of interest to all. To RSVP please send an email to: riversideleg@aol.com

Dear Chairman Stone and Committee Members,

 

DOGS, (Dog Owners of the Golden State), is an AKC State Federation for California, representing thousands of dog owners in our state. We are advocates for animal welfare, for promoting responsible dog ownership and for protecting the rights of responsible dog owners. We support animal legislation that provides positive benefits to society.

 

DOGS OPPOSES AB1491 which would prohibit leases of dogs for any reason. While your intentions may be to reduce or eliminate lawsuits in this area, the fact remains that legally, dogs and other animals are property, and as property, citizens have the right to sell, lease, donate, or enter into any contract regarding an animal as they deem mutually beneficial.

 

It is common for breeders and rescue organizations to adopt out dogs with contract provisions requiring return of the dog under certain circumstances. It is also common among dog owners, as an unpleasant side effect of dog ownership limit laws, to lease or co-own dogs for breeding purposes. AB 1491 would destroy this necessary method for maintaining healthy diverse gene pools in dog breeds. Additionally, This bill would jeopardize the legal right of the original owner or charitable organization to reclaim his dog in the event of specified problems with the new owner.  

 

We urge you to reject this proposal which would cripple the work of ethical, responsible breeders and rescue organizations. Such unreasonable regulations are not only burdensome to breeders and pet owners, they also are detrimental to the welfare of animals and harmful to the community.

DOG OWNERS OF THE GOLDEN STATE ALERT - AB 1491 makes leasing ILLEGAL

The California Legislature is entertaining a bill that would render contracts for leasing dogs null and void. Here is the legislative analysis:

This bill would declare a contract entered into on or after January 1, 2018, to transfer ownership of a dog or cat in which ownership is contingent upon the making of payments over a period of time subsequent to the transfer of possession of the dog or cat void as against public policy unless those payments are on an unsecured loan for the purchase of that animal. This bill would also declare a contract entered into on or after January 1, 2018, for the lease of a dog or cat void as against public policy. The bill would require that the consumer taking possession of a dog or cat transferred under the terms of one of these contracts be deemed the owner of the dog or cat and be entitled to return all amounts paid under the contract.

This bill would render leasing contracts for any reason as null and void. It would eliminate your choice to lease a dog for breeding purposes. Anyone who might choose to lease a pets.....can't imagine that people actually do this, but if so, that is their inherent RIGHT to make that CHOICE and DECISION independently....we don't need the government to insert itself into our private transactions. Dogs are property, and as such can be bought, sold and yes, leased.
